Welcome to Snijder Marine Services, hereinafter referred to as SMS.
These Terms and Conditions apply to all services, products, and website use provided by SMS.
By using our website or engaging our services,
you agree to these Terms in full. If you do not agree, you should discontinue use immediately.

 

1. About Us and Definitions

SMS (“we,” “us,” or “our”) refers to Snijder Marine Services.
“You” refers to any client, visitor, or business partner engaging with us or using our website.

For the purposes of these Terms:

  • Agreement: Any contract or engagement between SMS and the Client.

  • Client: Any individual or business engaging SMS’s services or purchasing products from SMS.

  • Services: Any maritime support, consultancy, or related service provided by SMS.

  • Website: The official SMS website and any content accessible through it.

  • Dayrate: The standard daily rate charged by SMS for one Working Day

  • Working Day: A day during which services are performed for a maximum of 12 hours.
    Any hours worked beyond 12 hours are considered overtime. 

  • Overtime: Any hours worked beyond a working day.

  • Cancellation: Termination of a confirmed order, booking, or project by the Client.

  • Travel Expenses: Costs incurred for travel by own car or otherwise.

2. Use of the Website

You may use our website only for lawful purposes and in a way that does not cause harm, restrict access,
or disrupt its functionality. While we strive to provide accurate and up-to-date information,
SMS cannot guarantee the completeness or reliability of any content.

 

3. Payment Terms

All invoices issued by SMS must be paid within 30 calendar days from the invoice date,
unless otherwise agreed in writing.

Rates and Working Hours:

  • A Working Day is a maximum of 12 hours; hours beyond this are considered overtime.

  • Overtime : €80 per hour, excluding VAT.

  • Travel days or day of travel, count as Working Days.

  • Travel expenses are charged at €0.35 per kilometer.

 

4. Cancellation Policy

If you wish to cancel a confirmed order, booking, or project, you must notify SMS in writing as soon as possible.
Unless otherwise agreed:

  • Cancellations made less than 10 calendar days before the start date will incur a fee of
    20% of the agreed amount.

  • SMS reserves the right to cancel or reschedule services in the event of unforeseen circumstances,
    without liability for compensation.

5.Retention of Ownership

All materials, documents, or products supplied by SMS remain our property until full payment has been made.
Until ownership is transferred, you may not sell, modify, or pledge any goods or materials received.
In case of non-payment, SMS reserves the right to reclaim or suspend the delivery of goods or services.

 

6. Liability

SMS will perform all services with due care and professionalism.
However, we cannot be held liable for:

  • indirect or consequential damages, such as loss of profit, delays, or data loss;

  • damages resulting from incorrect information provided by the Client;

  • circumstances beyond our reasonable control (see section 7).

Our total liability shall in any case not exceed the amount invoiced for the specific service that caused the claim,
unless otherwise required by law.

 

7. Force Majeure

SMS shall not be held responsible for any failure or delay in performance due to events beyond our reasonable control.
This includes, but is not limited to: natural disasters, extreme weather, war, strikes, government actions, pandemics, technical failures, or disruptions in transport or communication.
In such cases, SMS may suspend obligations for the duration of the event or, if necessary, terminate the agreement without liability for damages or compensation.

 

8. Intellectual Property

All content on this website, including text, designs, photographs, and logos, is owned by SMS unless otherwise stated.
You may not reproduce, distribute, or use any materials for commercial purposes without our written consent.

 

9. Confidentiality

SMS and the Client agree to treat all exchanged business information as confidential,
unless disclosure is required by law or consented to in writing.

 

10. Governing Law

These Terms and any agreement with SMS are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be submitted exclusively to the competent court in the Netherlands.

 

11. Amendments

SMS may update or modify these Terms at any time. The latest version will always be available on our website.
Continued use of our services after changes indicates your acceptance of the revised Terms.
